Model developed during/after employment

Dear all,

I have a question: If an employee has developed a model with the company. If s/he left the company subsequently, can the model be taken to another firm?

As far as I understand from Standard I©- Misrepresentation (Guidance: Work completed for firm), any work completed during employment belong to the firm and firm can use them without attribution; but existing employee cannot republish the report under their name. Also, under Standard IV(A)- Loyalty; I understand that any work performed for the firm need to be erased and returned to the firm, unless otherwise. In that light, the employee cannot take the model to another firm?

Thank you.

Cheers,

Ernest

employee needs permission from the firm to take the model. anything produced by employee at previous firm is the previous firm’s property.

yes

Thanks both!

How about recreating the model from memory? He doesn’t take away any materials from his previous employee.

A good case study (Optiver vs Tibra)

What if the employee recreated the model from random stuff online? Considering the fact that he knows how to make the model again, wouldnt that imply that he had copied the model?

A model recreated from scratch using only publically available information is not in violation of any standards and is allowed. Taking a model with you or using proprietary information, even if the information was created by you, is prohibited.
